10.COMPETITION RESULTS

10.1 The winning entry will be determined by identifying the player whose submitted coordinate is the closest to the actual impact point coordinate. The proximity is calculated based on the shortest Euclidean (straight line) distance between the player’s coordinate and the actual impact coordinate.

10.2 In circumstances where two or more players submit coordinates equidistant to the actual impact coordinate, the following tie-breaker criteria will apply in the order listed:

10.2.1 The player who completed their game session in the shortest time, measured precisely to the nearest millisecond, will be ranked higher.

10.2.2 If session completion times are identical, the player who used the fewest extension lines during their game session will be ranked higher.

10.2.3 If players remain indistinguishable after applying the above criteria, all such players will be declared joint winners. Each joint winner will be awarded the prize that they selected at the time of purchasing their respective Ticket.

10.3 The actual impact point is determined by the Company’s observation and marking of the original photo. By entering the competition, you acknowledge that the physical impact does not correspond exactly to a single pixel and that any minor variations are inherent in translating a real-world impact to a digital coordinate. Such variations shall not be grounds for dispute, and no correspondence, discussion, or negotiation will be entered into regarding them.

14.REFER A FRIEND

14.1 From time to time, we may offer a 'Refer a Friend' scheme at our sole discretion, which allows existing customers to earn rewards by referring genuine friends, family members, or acquaintances who subsequently register for a Prizerunners Account and participate in Competitions.

14.2 The specific terms, eligibility criteria, and rewards associated with the 'Refer a Friend' scheme, as well as any related promotional offers, will be detailed on the dedicated 'Refer a Friend' page on our Website and/or applications. Such terms may include: (a) Eligibility requirements for both the referring customer and the referred individual; (b) The minimum qualifying activity the referred individual must complete (e.g., purchasing a Ticket or entering a Competition); (c) The type and value of rewards issued to the referring customer; (d) Any restrictions on the number of referrals permitted per customer.

14.3 Referrals must be made in good faith. Any attempt to abuse or manipulate the scheme, including but not limited to referring oneself, creating fake accounts, or other fraudulent activities, will result in the disqualification of both the referrer and the referred party from receiving any rewards. We reserve the right to suspend or terminate any Prizerunners Account found to be in breach of this clause.

14.4 We reserve the right to withdraw, modify, or terminate the 'Refer a Friend' scheme or any associated promotional offers at any time without prior notice. Any changes will be communicated via our Website and/or applications.

14.5 Participation in the 'Refer a Friend' scheme constitutes acceptance of these Terms and Conditions, alongside any additional terms published in relation to the scheme.

15.PUBLICITY

15.1 Winners may be required to participate in reasonable publicity and promotional activities arranged by us in connection with the Competition. This may include, without limitation, providing photographs, participating in video interviews, or other forms of media which may be used by us for marketing, promotional, or public relations purposes.

15.2 By accepting a prize, Winners agree to grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, and publish their name, photograph, likeness, and any video or audio recordings provided, in any media format, including but not limited to our Website, applications, social media channels, and promotional materials.

15.3 For transparency and regulatory compliance, we may publish certain information about Winners to demonstrate that prizes have been awarded validly. This may include the Winner's name, country of residence, and a photograph. This information may be displayed on the 'Winners' section of our Website and/or applications.

15.4 If you do not wish for your information to be published for publicity purposes, you must notify us in writing at the time of being notified as a Winner. We will make reasonable efforts to respect such requests; however, you acknowledge and accept that we may still be required to disclose your personal information to regulatory authorities, such as the Advertising Standards Authority, or to law enforcement agencies upon lawful request.

15.5 Participation in our Competitions constitutes your consent to these publicity terms unless you have expressly opted out in accordance with clause 15.4.

16.YOUR BREACH OF THE TERMS AND CONDITIONS

16.1 To the fullest extent permitted by applicable law, you agree to fully indemnify, defend, and hold harmless the Promoter, together with our officers, directors, employees, agents, affiliates, and suppliers, from and against any and all losses, liabilities, damages, claims, costs, expenses (including reasonable legal fees), or similar liabilities that are incurred or sustained by us as a result of: (a) Your breach of any provision of these Terms and Conditions; (b) Your misuse of the Services; (c) Any violation of applicable laws or regulations arising from your conduct; (d) Any third-party claims brought against us as a consequence of your actions or omissions.

16.2 We reserve the right, at our own expense, to assume exclusive control over the defence and settlement of any claim, demand, action, or proceeding brought against us that arises in connection with your use of the Services or any breach of these Terms and Conditions. In such an event, you agree to cooperate fully with us in asserting any available defences and in all aspects of the legal proceedings.

16.3 The indemnity provided under this clause is in addition to, and does not replace, any other rights or remedies that may be available to us under these Terms and Conditions or applicable law.

17.DISCLAIMERS AND LIMITATIONS OF LIABILITY

17.1 Nothing in these Terms and Conditions shall limit or exclude our liability for: (a) Death or personal injury caused by our negligence; (b) Fraud or fraudulent misrepresentation; or (c) Any liability that cannot be excluded or limited under applicable law.

17.2 If we fail to comply with these Terms and Conditions, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our negligence. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time of entering into these Terms and Conditions. We are not responsible for any loss or damage that is not foreseeable.

17.3 Our maximum aggregate liability to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with: (a) Your participation in a Competition where you have won a prize shall be limited to the cash value of the prize; (b) The loss or deletion of your entry or a failure to process your entry shall be limited to the provision of a replacement ticket to participate in a subsequent Competition.

17.4 To the fullest extent permitted by law and without prejudice to your statutory rights, we shall not be liable for any loss or damage suffered by you or any third party arising from: (a) Your use of the Services in breach of these Terms and Conditions; (b) The misconduct, abuse, or misuse of the Services by other users; (c) Delays in the supply or delivery of any prize; (d) The cancellation or claw-back of any prize in accordance with these Terms and Conditions; (e) Any system, hardware, software, network, internet, or electronic failures, bugs, viruses, or errors unless due to our failure to use reasonable skill and care; (f) Events beyond our reasonable control, including but not limited to: (i) Acts or omissions of third-party service providers; (ii) Your or others' misuse of the Services; (iii) Failures of your equipment or hardware used to access the Services; (iv) Failed, partial, or garbled transmissions; (v) Unauthorised access to or alteration of your data; (vi) Acts of war, terrorism, civil unrest, natural disasters, or governmental actions. (g) Damage to your equipment or hardware or data loss or corruption resulting from use of the Services, except where defective digital content supplied by us damages your device and this is due to our failure to use reasonable skill and care. In such cases, we will either repair the damage or compensate you.

17.5 We reserve the right to extend, cancel, terminate, modify, or suspend any Competition where, due to unforeseen circumstances such as computer viruses, network failures, software errors, unauthorised interventions, or fraud, the Competition cannot run as originally planned. We may, in our sole discretion, invalidate affected entries and: (a) Select a Winner from all valid and eligible entries received prior to the decision to terminate the Competition; or (b) Close the Competition without selecting a Winner, in which case all entrants will be provided with a replacement ticket to enter a subsequent Competition.

17.6 For the avoidance of doubt, only entry coordinates for Find the Impact Competitions and order details recorded in our systems will be considered valid for entry into the relevant Competition. We shall not be held liable for any entries affected by software malfunctions or other technical failures. You can verify your Competition entries at any time by accessing your Prizerunners Account.

17.7 We do not exclude or limit our liability to you in any way where it would be unlawful to do so.
